O R D E R
This petition has been filed to direct the second respondent not to harass the petitioners, under the guise of enquiry.
2. The petitioners are wife, husband and son. The petitioners have admitted that they have borrowed some amount from one Gowsalya and that they have handed over two unfilled cheques and blank Pronote. It is further stated that the third respondent, who is the sister of Gowsalya, has given a complaint as if the petitioners have cheated them. Now the parties, during the pendency of this petition, have settled their dispute amicably, as it was suggested by the https://hcservices.ecourts.gov.in/hcservices/
Court. The petitioners herein have agreed to pay a sum of Rs.3,00,000/-. Similarly, the third respondent has also agreed to return the blank Pro-note and two blank cheques, upon receipt of the said amount.
3. As per the undertaking given by the respective parties, the learned Counsel for the petitioners has handed over a Demand Draft to the learned Counsel for the third respondent, for a sum of Rs.3,00,000/-, in favour of the third respondent. Similarly, the learned counsel for the third respondent has handed over the two unfilled cheques and one blank Pro-note to the learned counsel for the petitioners.
4. Since the parties have settled their dispute and the settlement has also acted upon by this Court, recording the above facts, this petition is closed as no further order is required. It is made clear that in relation to the complaint given by the third respondent, the petitioners shall not be harassed by the respondent Police as the complaint itself is closed.
