ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent Police for the offences under Sections 147, 148, 294(b), 324, 452, 420, 506 (ii) of I.P.C and Section 4 of the Tamil Nadu Prohibition of Harassment of Woman Act, 2002 and Section 3 of the Tamil Nadu Public Property (Prevention of Damage & Loss) Act, 1992 in Crime No.57 of 2018, seeks anticipatory bail. He has been shown as accused No.3.

2.Heard the learned counsel appearing for the petitioner as well as the learned Government Advocate (Crl Side) appearing for the respondent and Mr.V.Balaji, learned counsel appearing for the de facto complainant.

3.The petitioner is aged about 71 years. This Court went through the contents of the First Information Report. Though serious injuries has been caused to the de facto complainant, it appears that the petitioner did not cause them. Undertaking affidavit is given before this Court by the petitioner stating that the petitioner will not to interfere with the possession and enjoyment of the property in question to the de facto complainant or his family.

4.Recording the undertaking given by the petitioner, hence, anticipatory bail is granted to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Karur and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

5.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
