This Writ Petition has been filed seeking issuance of a Writ of Certiorarified Mandamus to call for the records of the third respondent pertaining to the impugned rejection order bearing No. 2025/0105/24/761424 dated 25.08.2025 and quash the same as illegal, void and arbitrary and consequently direct the fourth respondent to survey and subdivide the property and the third respondent to issue joint patta in favour of the petitioner in respect of the property comprised in Punja ReSurvey No.25/1B, situated at Poolampatti Village, Madurai North Taluk, Madurai District, within a time frame to be stipulated by this Court. 2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
3. By the impugned order dated 25.08.2025, the third respondent rejected the petitioner's application for transfer of patta in respect of the subject property.
4. A perusal of the impugned order of the third respondent reveals that the petitioner's request for transfer of patta was rejected based on the report of the Zonal Deputy Tahsildar. However, the impugned order also indicates that once the deficiencies are rectified, the petitioner may submit a fresh application.
5. In view of the above, in the event of the petitioner submitting a fresh application along with all the necessary and relevant documents, after the rectification of deficiencies, the third respondent shall consider and dispose of the same on its own merits and in accordance with law, after affording due opportunity to all necessary parties concerned, within a period of twelve (12) weeks from the date of receipt of such application. 6. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
