Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 3rd Respondent to release the Petitioners Tipper Lorry bearing registration number TN 21 H 5754 seized on 23.10.2018 and keeping under the custody of the 3rd Respondent by consider his representation dated 30.10.2018. ORDER:

This Writ Petition is coming under the Caption "for being mentioned" on this day, upon perusing the petition and affidavit and order dated 11.02.2019 passed in this Court and upon hearing the arguments of Mr.K.Arunraj, Advocate for the petitioner and Mr.M.Rajarajan, Government Advocate on behalf of the respondents, this Court made the following order:

The case is posted under the caption 'for being mentioned'. 2.The learned counsel appearing for the petitioner informs the Court that he complied with all the conditions stipulated by this Court. But the vehicle in question is not being released as it has been handed over to the custody of the Court concerned. 3.This Court wanted to know whether the vehicle was produced before the Jurisdictional Magistrate after 11.02.2019. 4.The petitioner's counsel states that the vehicle was handed over to the custody of the Court concerned only after 11.02.2019. 5.Therefore, the Judicial Magistrate, Keeranur, is directed to return the vehicle to the petitioner herein.
