Respondents PRAYER: Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure praying to direct the learned District and Sessions Judge, at Theni, Theni District, under the SC/ST Prevention of Atrocities Act, 1989 to accept the surrender of the petitioner and consider the bail application on merits on the same day in connection with Cr.NO.213 of 2015, on the file of the first respondent.

2. The petitioner, who apprehends arrest for the offences punishable under Sections 341, 294(b), 323, 427, 506(i) I.P.C. r/w 3(1)(r)(s) 3(2)V (a) of SC/ST Prevention of Atrocities Act (Amendment Ordinance Act 2014)in Cr.No.213 of 2015, on the file of the respondent police, move this petition seeking direction to the learned District and Sessions Judge, at Theni, Theni District, to be considered the bail application filed by the petitioner on the same day of his surrender.

3. Perused the records.

Considering the facts and circumstances of the case, the petitioner is directed to surrender before the concerned Court after giving notice to the learned Public Prosecutor within a period of ten days from the date of receipt of a copy of this order and on such surrender, the concerned Court is directed to pass order purely on merits and in accordance with law on the same day.

5. Accordingly, this Petition is ordered.
