ORDER

This petition has been filed seeking for a direction to the District Munsifcum-Judicial Magistrate, Krishnarayapuram, Karur District, to take on file in Crl.MP.Sr.No.49/2026 and number the same and pass appropriate orders in accordance with law, on the complaint of the petitioner within a reasonable time.

The petitioner is a practicing advocate, who appeared in person before this Court, submitting that on 25.10.2025, at about 12:05 a.m., while he was at his house with his mother, wife, and minor son, some unknown accused persons, with a clear and deliberate intention to murder the petitioner and his entire family, exploded a country-made explosive (Nattu Vedikundu) on the terrace of the petitioner's house. The explosion produced bombarding sounds along with intense fire and light.

3. Pursuant to the above incident, the petitioner immediately called the emergency helpline 112, but received no response. However, he received an SMS acknowledgment confirming the registration of the call with ID 653793 / TN2051025000170. At about 02:07 a.m., the police officials contacted the petitioner from mobile number 9384039371, and the petitioner elaborated the 2/6

entire incident. However, no one arrived to respond. Due to the inaction of the respondent police, the petitioner lodged a written complaint on 10.11.2025 to all the respondents. Even after this, there was no response.

The petitioner, who is the party-in-person, further submitted that since there was no response, the petitioner filed a petition before the District Munsifcum-Judicial Magistrate, Krishnarayapuram, Karur District, in Crl.MP.Sr.No. 49/2026 on 03.02.2026, seeking to direct the third respondent police to register an FIR. However, it was returned on 17.02.2026, as the procedure under Section 173(4) of the BNSS had not been followed by the petitioner. The petitioner subsequently complied with the necessary procedure and has resubmitted the petition. However, the petition remains pending without being taken on file or numbered. Hence, the petitioner seeks the indulgence of this Court, requesting a direction to the District Munsif-cum-Judicial Magistrate, Krishnarayapuram, Karur District, to take on file the petition in Crl.MP.Sr.No. 49/2026, number it, and dispose of it.

5. The learned Government Advocate appearing for the respondents submitted that a discrete enquiry was conducted and the same was also closed. 3/6

6. Heard the learned counsel on either side and carefully persued the materials available on records.

The cry of the petitioner which inspired the conscious of this Court is that the advocate had to run to pillar and post before the jurisdictional police station to get a CSR on making a complaint in this manner. Even the third respondent police had been reluctant to issue a CSR. In view of the same, the petitioner is directed to give a complaint afresh to the third respondent police. On receipt of the same, the third respondent police is directed to issue a CSR forthwith and thereafter, conduct a proper enquiry by recording the statements of all the necessary parties and conclude the enquiry as expeditiously as possible within a period of four weeks from the date of receipt of a copy of this order.

8. With the above direction, this criminal original petition stands disposed of.
