ORDER : The Court Made the following order :- The petitioner, who is arrayed as A-2 in S.C.No.2 of 2015 on the file of the learned Chief Judicial Magistrate-cum-Special Judge, Nagercoil for the offences under Section 7 of the Prevention of Corruption Act, 1988, apprehends arrest at the hands of the respondent police and hence, seeks anticipatory bail.

2. The learned Counsel for the petitioner submits that the learned Judge issued non-bailable warrant against the petitioner for his nonappearance before the Court. It is further submitted that absence of the petitioner is neither willful nor wanton. He would further submit that the petitioner undertakes to appear before the Court below on the next hearing date.

3. Heard the learned Government Advocate (Crl. Side) on the submissions made by the learned counsel for the petitioner. 4.Considering the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is directed to be released on bail in event of arrest or on his appearance before the learned Chief Judicial Magistrate, Nagercoil, on his executing a bond for a sum of Rs.10,000/- (Rupees ten Thousand only) to the satisfaction of the learned Judicial Magistrate concerned and on further condition that the petitioner shall appear before the trial Court on all future hearing dates except the dates on which the petitioner files a petition under Sections 317 Cr.P.C. by assigning valid reasons. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

5. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. sd/- 23/06/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
