ORDER : The Court Made the following order :- The petitioner/A1 apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 452, 147, 148, 324, 307 and 506(ii) IPC r/w 109 IPC in Crime No.77 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.

2. The learned counsel appearing for the petitioner submitted that the petitioner/A1 is not present in the place of occurrence. According to the prosecution, the first accused instigated the other accused for the commission of offences. The learned counsel appearing for the petitioner further submitted that the accused, who attacked the victim by Aruwal, has already been granted bail by the learned Principal Sessions Judge, Tirunelveli, in Crl.M.P.No.1388 of 2015 dated 17.03.2015. Hence, the learned counsel prays for anticipatory bail in favour of the petitioner.

3. Heard the learned Government Advocate (Crl.Side) appearing for the respondent.

4. Considering the facts and circumstances of the case and also considering the fact that the accused, who attacked the victim by Aruval, had already been granted bail, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.V, Tirunelveli and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m. until further order. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

5. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
