BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED: 28.02.2025

CORAM:

THE HON'BLE MR.JUSTICE P.B. BALAJI W.P.(MD).No.5436 of 2025 Arunachalam ... Petitioner Vs.

1. The District Revenue Officer, Thoothukudi District, Thoothukudi.

2. The Sub Collector, Office of the Sub Collector, Thoothukudi District.

3. The Tahsildar, Office of the Tahsildar, Srivaikundam Taluk, Thoothukudi District ... Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents to mutate the patta in the name of the Petitioner by considering the representation given by the Petitioner dated 17.05.2023. For Petitioner : Mr.G.Prabhu Rajadurai For Respondents : Mr.B.Saravanan Additional Government Pleader 1/4

ORDER

Mr.B.Saravanan, learned Additional Government Pleader takes notice on behalf of the respondent.

2. The petitioner seeks issuance of writ of mandamus to direct the respondents to consider the petitioner's representation dated 17.05.2023, to effect corrections in the UDR records and issue patta to the petitioner.

3. Considering the limited relief sought for in the writ petition, with the consent of the parties, the writ petition itself is taken up for final disposal.

4. It is the short contention of the learned counsel for the petitioner that in respect of the petitioner's property patta has been wrongly issued in the name of the temple. The specific contention of the petitioner is that the Village Administrative Officer, after conducting an enquiry, recommended the corrections to be carried out and patta to be mutated in the name of the petitioner. Even the Revenue Inspector has given no objection for such exercise to be carried out.

5. The grievance of the petitioner is that the matter is pending with the 1th respondent without any progress for the past several years, inspite of the positive recommendations issued by the Village Administrative Officer as well as the Revenue Inspector.

6. Considering the fact that the petitioner's application has been kept alive since 17.05.2023, it would suffice to issue a direction to the 1st respondent to pass orders in the petitioner's application based on the recommendation of the Village Administrative Officer as well as the Revenue Inspector. The said exercise shall be carried out within a period of four weeks from the date of receipt of a copy of this order.

7. The writ petition is disposed of with the above observations and directions. No costs.
