ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos. 1 to 6 in Crime No.136 of 2015 on the file of the file of the respondent police, apprehend arrest for the offences punishable under Sections 147, 148, 341, 323, 324 and 307 of I.P.C,and hence seek anticipatory bail.
2. The case of the prosecution is that due to previous enmity, the defacto complainant lodged a complaint against the petitioner, which has been registered in Cr.No.136 of 2015 by the respondent Police.
3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and they are having permanent abode and they are ready to furnish adequate solvent sureties for their release on bail, in the event of their arrest to the satisfaction of the learned Judicial Magistrate No.VI, Madurai.
4. The learned Government Advocate (crl. Side), on instructions from the respondent, reported that there are certain previous cases pending as against A-2 to A-5 and that the injured has already been discharged from the hospital and therefore, he requested for imposing the stringent conditions, in the interest of justice. https://hcservices.ecourts.gov.in/hcservices/
5.On consideration of the facts and circumstances of the case and the submissions made, this Court is of the view that the petitioners can be granted the relief prayed for with conditions, and accordingly;
(a) In the event of arrest by or on appearance before the respondent police;
(b) In the event of appearance before the learned Judicial Magistrate, No.VI, Madurai within fifteen days from the date of receipt of a copy of this order;
(i) The petitioners shall be enlarged on bail on each of them executing a bond for Rs.10,000/- (Rupees Ten Thousand Only) with two sureties each for the like sum to the satisfaction of the learned Judicial Magistrate, No.VI, Madurai;
(ii) The petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the fact of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
(iii) The petitioners shall appear before the respondent Police on all working days daily twice i.e at 10.00 a.m. and 5.00 p.m until further orders.
The petitioners shall appear before the concerned Magistrate within a period of fifteen days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
