O R D E R

This Criminal Original petition is filed for issuing a direction to the respondents to file final report in Crime No.102 of 2017 on the file of the second respondent police within a time stipulated by this Court.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. The petitioner states that the property bearing Door No.17, Alagaradi 4th Street, Madurai, belongs to her mother. It is stated that the proposed accused who are the tenants residing in one portion of the building were demanding illegal ratification for vacating the property. It is further stated that they threatened the petitioner and her mother with dire consequences to pay Rs.5,00,000/- for vacating the property. It is also the case of the petitioner that the proposed accused had not paid rent for the building.

4. Learned Additional Public Prosecutor however on instructions submitted that the complaint as against the individuals were

enquired into and closed as "Mistake of Fact" and R.C.Notice was also served on the petitioner even on 16.02.2016.

5. The statement about the service of R.C.Notice on the petitioner is denied by the learned counsel for the petitioner. Though the learned Additional Public Prosecutor has produced the acknowledgement receipt of the said notice, for convenience, the learned Additional Public Prosecutor is directed to serve a copy of the R.C.Notice along with closure report in the course of the day.

6. Having regard to the above circumstances, the Criminal Original petition is dismissed.
