ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offence punishable under Section 376 of I.P.C., in Crime No. Not known of 2017 on the file of the respondent police and hence seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and his wife adopted one Priyanka, who was found missing on 24.06.2017 and was found by the Railway Police, Trivandram City and a case has also been registered by Trivandram Railway Police. Thereafter, a statement was also recorded from the said Priyanka, wherein she stated that the petitioner raped her.

3. The learned Government Advocate (Crl.side) appearing for the State submitted that as on today, no case was registered against the petitioner and another he is accused or not, can be decided only after conducting investigation.

4.In view of the aforesaid submission made by the learned Government Advocate(Criminal side) this Criminal Original Petition0 is pre-matured one and accordingly, the same is dismissed with liberty to the petitioner to approach the appropriate forum, as and when apprehension arise.
