ORDER

This Criminal Original Petition has been filed to direct the 3rd respondent not harass the petitioner and his family members under the guise of enquiry on the petitioner's representation dated 04.02.2026.

2. The learned counsel for the petitioner submitted that the respondent police is continuously subjecting the petitioner harassment in the guise of inquiry without issuing any summons. Hence, this petition.

3. The learned Government Advocate (Crl. Side) categorically submitted that the petitioner is a History Sheeter in H.S.No.442 of 2025 Due to the advent of the election, the respondent police is swiftly taking action to maintain the law and order problem in the locality by giving alerts to the various trouble mongers, and there is nothing to panic about in this exercise.

4. Heard the learned counsels on either side and carefully perused the materials available on record.

It is made clear that facilitating the maintenance of law and order in the locality is otherwise not subjecting the petitioner to any harassment without issuance of a summons./notice under Section 62 Crl.P.C.,/ 64 BNSS, 2023, specifying the date, time, and purpose of enquiry. Oral or informal summons are prohibited. However, the petitioner is also directed not to create any trouble or disharmony in the community.

6. With the above directions, this Criminal Original Petition is disposed of.
