Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as Accused Nos.3 & 4, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 36(A) and 41(1) of Chapter V of the Tamil Nadu Forest Act, 1882 in SWOR No.2 of 2016, on the file of the respondent police and hence, seek anticipatory bail. 2.The case of the prosecution is that on 15.07.2016, an Auto bearing Registration No.TN-76-D-1224 driven by A.1 was inspected and found that 8 pieces of sandal wood in a gunny bag. The petitioners ran away from the place of occurrence and A.1 was arrested and on complaint, a case has been registered against the petitioners. 3.The case of the petitioners is that the petitioners are innocent and they have not committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Crl.Side) submitted that the petitioners involved in smuggling sandal wood and the investigation is pending to find out the persons involved in the smuggling and if anticipatory bail is granted to the petitioners, they will tamper the witnesses.

5.Considering the fact that the petitioners are smuggling sandal woods and to find out the fact that who are all involved in the case, the custodial interrogation of the petitioners are necessary, this Court is not inclined to grant anticipatory bail to the petitioners and this Criminal Original Petition is dismissed. sd/- 22/07/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.)
