Prayer : Civil Miscellaneous Petition is filed under Order 5 Rule 20 (1A) of the Code of Civil Procedure, to permit the petitioner to effect substituted service by way of paper publication in respect of 3rd and 5th respondents in a vernacular language newspaper in the locality where he reside/last known address in the First Appeal.

ORDER

This Civil Miscellaneous Petition has been filed seeking permission to permit the petitioner to effect substituted service by way of paper publication in respect of the 3rd and 5th respondents in a vernacular language newspaper in the locality where they reside or at their last known address, in the Appeal Suit in A.S.(MD)No.88 of 2023 on the file of this Court.

2. Heard the learned counsel for the petitioner and perused the affidavit filed in support of this petition.

3. The learned counsel for the petitioner submitted that the 5th respondent has died and that steps have already been taken in respect of the deceased 5th respondent.

4. Being satisfied with the reasons stated in the affidavit, this Civil Miscellaneous Petition is allowed insofar as the 3rd respondent is concerned.
