O R D E R
The Criminal Petition Petition is filed for a direction to the learned Judicial Magistrate No.1, Ramanathapuram to complete the trial in C.C.No.162 of 2009 within the time frame as fixed by this Court.
2.The petitioner is the sole accused in the criminal case pending before the learned Judicial Magistrate No.1, Ramanathapuram in C.C.No.162 of 2009. Though the trial of the proceedings was delayed due to the absence of the petitioner on many occasions, the learned Counsel for the petitioner submitted that the petitioner's non appearance was due to the petitioner's engagement in abroad. proceedings and a direction for the disposal of the proceedings at earlier date, will be in the interest of justice. 3.Considering the nature of grievance expressed by the learned Counsel for the petitioner and facts and circumstances of the case, this Court is inclined to issue the following the direction: "The learned Judicial Magistrate No.1, Ramanathapuram, is directed to expedite the trial in C.C.No.162 of 2009 and dispose of the same within a period of three months from the date of receipt of a copy of this order".
4.In view of the above direction, the Criminal Original Petition is allowed.
