ORDER : The Court Made the following order :- The petitioner, who is the sole accused in Crime No.426 of 2015 on the file of the respondent police apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 366(A) of I.P.C and Sections 9 and 10 of Protection of Children from Sexual Offences Act, 2012 and hence, seeks anticipatory bail.
2. It is submitted by the learned counsel for the petitioner that the daughter of the defacto complainant is aged about 17 years and there is no sexual harassment.
3. It is represented by the learned counsel for the petitioner and the learned Government Advocate(Crl. Side) that this is a case of love affair and the accused and the defacto complainant has appeared before the Mediation and Conciliation Centre attached to this Bench and the accused has given an undertaking that he will not meet the daughter of the defacto complainant and the defacto complainant has also agreed to withdraw the complaint.
4.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Special Judge cum Mahila Court, Theni, and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner https://hcservices.ecourts.gov.in/hcservices/
shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
5. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
