Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners are the accused Nos.1 to 4 and they apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 376(1), 506(ii), 366, 496 r/w. 34, 109 of I.P.C., and Section 4 of Protection of Children from Sexual Offences Act, 2012 in Special S.C.No.4 of 2014 on the file of the learned Special Judge, Mahila Court, Pudukottai and hence, seek anticipatory bail.

2. The learned Government Advocate (Crl.side) represented that in this case, Non-Bailable Warrant was issued against the petitioners on 07.05.2015 after dismissing 317 Cr.P.C. petition by the learned Special Judge, Mahila Court, Pudukottai for the nonappearance of the petitioners.

3. Since Non-Bailable Warrant is pending against the petitioners from 07.05.2015, no anticipatory bail can be granted by this Court and this petition is dismissed. However, the petitioners are at liberty to surrender before the learned Special Judge, Mahila https://hcservices.ecourts.gov.in/hcservices/

Court, Pudukottai within a period of one week from the date of receipt of a copy of this order after giving notice to the learned Public Prosecutor and to file an application for bail and in the event of filing such an application, the learned Special Judge, Mahila Court, Pudukottai is directed to consider the bail application and pass orders, on the same day, on merits and in accordance with law.
