The petition has been filed under Section 482 Cr.P.C, praying to withdraw and transfer the case in CC No.134/2013 on the file of the Learned Judicial Magistrate No.I, Kuzhithurai, Kanyakumari District to any other court which is competent to try the offences in the nearby District viz. Tirunelveli more particularly the Learned Judicial Magistrate, Valliyoor, Tirunelveli District forthwith.

2. When the matter is taken up for hearing, the learned counsel appearing for the second respondent has agreed that the case may be transferred to the learned Judicial Magistrate, Valliyoor, Tirunelveli District.
