Respondent PRAYER : Writ Petition is filed under Article 226 of Constitution of India, to issue a writ of Mandamus directing the Respondent to fix the pay of the Petitioner in pay matrix of Rs.45,400/- as provided in the Tamil Nadu Revised Pay Rules, 2017 as per the 7th Pay Commission recommendation with effect from 01.01.2016 and arrears with effect from 01.10.2017. Seeking a direction to the respondent to fix the pay of the petitioner as per the 7th Pay Commission recommendation, the petitioner is before this Court.
2.Heard the learned counsel for the petitioner and the learned counsel for the respondent.
3.The case of the petitioner is that he is working as an Assistant in the respondent University. It is his grievance that his basic pay was wrongly fixed and his juniors have been paid more than to him. To rectify the anomaly and to implement the pay fixation as per 7th pay commission's recommendation, the petitioner has given representations dated 26.09.2018 and 23.11.2018 to the respondent. Since there was no response from the respondent, the petitioner is before this Court.
4.Heard the learned counsel for the petitioner and the learned counsel for the respondent, who fairly submitted that the claim of the petitioner would be considered on merits. https://hcservices.ecourts.gov.in/hcservices/
5.In view of the above, the respondent is directed to consider the petitioner's representation dated 23.11.2018 in line with the 7th pay commission's recommendation and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order, after due opportunity of hearing to the petitioner. 6.The writ petition is disposed of with the above direction. No costs. Consequently, WMP(MD)No.196 of 2019 is closed.
