O R D E R
The petitioner/wife, who is facing the proceedings for dissolving the marriage at the instance of the husband in H.M.O.P.No.6 of 2019, on the file of the the Subordinate Court, Uthamapalayam, Theni District, seeks transfer of the same to the Family Court at Karur District, to be tried along with petition for restitution of conjugal rights filed by her in H.M.O.P.No.46 of 2018.
2. Admittedly, the wife resides at Karur District and transfer is sought for mainly on the ground of convenience. The respondent denies the averment and opposed the transfer sought for.
3. Considering the convenience of the wife, H.M.O.P.No.6 of 2019, on the file of the the Subordinate Court, Uthamapalayam, can be transferred to the Family Court, Karur District, to be tried along with H.M.O.P.No.46 of 2018.
4. In view of the above, this Transfer Civil Miscellaneous Petition is allowed and the proceedings in H.M.O.P.No.6 of 2019 is withdrawn from the file of the Subordinate Court, Uthamapalayam and transferred to Family Court, Karur District, to be tried along with https://hcservices.ecourts.gov.in/hcservices/ 1/2
Tr.C.M.P(MD)No.150 of 2020 H.M.O.P.No.46 of 2018. The learned Judge, Subordinate Court, Uthamapalayam, is directed to transmit the papers to the Family Court, Karur District, forthwith.
5. The learned Judge, Family Court, Karur District, is directed to dispose of the proceedings in H.M.O.P.No.6 of 2019 along with H.M.O.P.No.46 of 2018, within a period of six months from the date of receipt of the papers from the Subordinate Court, uthamapalayam, after due notice and opportunity to both parties. However, there will be no order as to costs. Consequently, connected miscellaneous petition is closed.
