ORDER : The Court Made the following order :- The petitioner, who is the sole accused in Crime No.103 of 2014 on the file of the respondent police, was arrested on 23.12.2014 in pursuance of the Non-Bailable Warrant issued on 28.11.2014, for the alleged offence under Section 302 of I.P.C., and hence, seeks bail.
2. The learned counsel for the petitioner submitted that the petitioner was regularly appearing before the trial Court and only on 28.11.2014, he was not appear before the trial Court due to the reason that he had mistakenly noted the hearing date and thereafter, he was immediately arrested and remanded to judicial custody. The learned counsel for the petitioner further submitted that originally he was defended by a counsel appointed by the Legal Aid Committee and now he has engaged a private advocate and conducting a fair trial, the petitioner is entitled for bail. The learned counsel for the petitioner also submitted that the chief examination of the Investigating Officer is over and the accused has to cross-examine the witness.
3. Per contra, the learned Government Advocate (Crl.side) submitted that the entire evidence is over and now the case is posted for arguments.
4. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two https://hcservices.ecourts.gov.in/hcservices/
sureties each for a like sum to the satisfaction of the learned Sessions Judge, Mahila Court, Pudukottai and on further condition that the petitioner shall appear before the trial Court for all future hearing dates without fail.
