RESPONDENT/COMPLAINANT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to relax the condition imposed by this Honble Court in Crl.OP(MD)no.745/2023 dt.11/1/2023 and to direct the trial court to return the passport.
Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.V.KATHIRVELU, Senior Counsel for M/S.SENTHILKUMAR A, Advocate for the petitioner and of M.VEERANTHIRAN, Government Advocate(Crl.Side) on behalf of the Respondents the court made the following order:- This petition has been filed to relax the condition imposed by this Court in Crl.O.P.(MD)No.745 of 2023, dated 11.01.2023. 2.The learned Senior Counsel appearing for the petitioner would submit that the petitioner has also having business interest in Singapore and occasionally, he used to travel to Singapore. He would further submit that the petitioner is ready and willing to appear before the respondent Police as and when required.
He would also submit that the petitioner's brother had filed a petition before this Court in Crl.M.P.(MD)No.2478 of 2023 in Crl.O.P.(MD) No.22614 of 2022 for relaxing the condition and this Court had also directed to return the original passport of the petitioner's brother with the condition to deposit original title deed in respect of the property bearing Doc.No.3173 of 2007, dated 25.07.2007 belonging to the mother of the petitioner and he would submit that the petitioner is ready to appear before the respondent for the purpose of investigation as and when required and seeks relaxation of condition and a for a direction to return the original passport of the petitioner.

3.Considering the submission made by the learned Senior Counsel for the petitioner, the order of this Court made in Crl.O.P.(MD) No.745 of 2023, dated 11.01.2023, is modified and the learned Judicial Magistrate No.II, Pudukottai, shall return back the passport of the petitioner deposited by him to the credit of crime number.
