The petitioner/A3, who was arrested and remanded to judicial custody on 13.09.2023 for the offences punishable under Sections 8 (c ), 20(b) (ii) (C) 25 and 29 (1) of Narcotic Drugs and Psychotropic Substances Act, 1985, in Crime No.374 of 2023, on the file of the respondent police, seeks bail.

The case of the prosecution is that on 09.05.2023, at about 17.15 hours, based on secret information, the respondent conducted vehicle check up near Hanna Joseph Hospital at Madurai - Thoothukudi ring road. Whileso, they saw the co-accused Rajkumar coming in a vehicle bearing Registration No.TN-85-E-8763. The respondent stopped the vehicle and enquired the driver. They found the co-accused Rajkumar in possession of 40 Kgs Ganja. The petitioner along with other accused were found in total possession of 2050 Kgs of Ganja, hence the case came to be registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and has not committed any of the offences alleged by the prosecution. He further submitted that the petitioner has been in judicial custody since 13.09.2023. It is also submitted that the petitioner had earlier filed a bail petition in Crl.M.P.No. 560 of 2025 before the 2/5

learned Principal Special Court for Trial of NDPS Act Cases, Madurai, which was dismissed on 12.03.2025. Hence, he prayed for the grant of bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the petitioner is involved in three previous cases and that a huge quantity of contraband was recovered. He further submitted that the petitioner has not satisfied the requirements under Section 37 of the NDPS Act. Hence, he strongly objected to the grant of bail to the petitioner.

Taking into consideration the rival submissions made on either side, as well as the gravity of the offence and the fact that the petitioner is involved in three previous cases and was in possession of a huge quantity of contraband, this Court is not inclined to grant bail to the petitioner, as the petitioner has failed to satisfy the requirements under Section 37 of the NDPS Act.
