The Criminal Original Petition is filed for a direction to the third respondent not to harass the petitioner and his family members on the guise of enquiry.
2.Heard Mr.S.Sathya Chidambaram, learned Counsel for the petitioner and Mr.A.Ramar, learned Additional Public Prosecutor, who takes notice for the respondents.
3.It is stated that the petitioner is being called by the respondent police and the third respondent is threatening to foist a false case against the petitioner. Though the petitioner had filed an Anticipatory Bail petition, before this Court in Crl.O.P(MD) No.14649 of 2017, the said petition was closed in view of the submission made by the learned Government Advocate (Crl.Side), that no enquiry or petition is pending against the petitioner. https://hcservices.ecourts.gov.in/hcservices/
4.It is further alleged that the respondent police has subsequently called upon the petitioner under the guise of enquiry, even though no complaint was received as against the petitioner. It is in these circumstances, the learned Counsel for the petitioner stated that a direction by this Court to the second respondent will be in the interest of justice.
5.The learned Additional Public Prosecutor, on instructions, submitted that no complaint or petition is pending against the petitioner and that no enquiry is contemplated as against the petitioner. It is further submitted that the petitioner was not called for any enquiry and there is no question of harassment, as alleged by the petitioner.
6.Recording the statement of the Additional Public Prosecutor, the Criminal Original Petition is closed.
