PRAYER : Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Certiorari, calling for the records pertaining to the impugned order issued by the first respondent vide Na.Ka.No. 175/Thu.tha/2022, dated 21.09.2022 and quash the same. ORDER

The present Writ Petition has been filed to quash the impugned order issued by the first respondent vide Na.Ka.No.175/Thu.tha/2022, dated 21.09.2022. 2.The present impugned order is passed under Section 68(2) of the Registration Act. After passing the order, the Petitioner has already filed a suit in O.S.No.6 of 2023 on the file of the District Munsif Court, Thirumayam and the same is pending.

3.The learned counsel appearing for the petitioner vehemently submitted that even though notice was served, he could not appear for the enquiry. 4.On perusal of the same, it is seen that the petitioner's name Micheal is finding place in the order. The submission of the petitioner cannot be a ground to set aside the impugned order. However, when the suit is pending before the competent civil Court, the petitioner cannot maintain another parallel litigation by filing a writ petition.

5.Accordingly, this Writ Petition is dismissed. However, the trial court shall consider the suit independently and uninfluenced by the observation made in this order or the observation made in the impugned order and pass appropriate order on merits and in accordance to law. The petitioner is permitted to amend the prayer if so advised. No costs. Consequently, the connected writ miscellaneous petitions are closed.
