ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police in pursuance of the Non Bailable Warrant issued in C.C.No.

73 of 2008 on the file of the learned Judicial Magistrate, Tenkasi, for the alleged offence punishable under Sections 4(1)(aaa), 4(1)(A) of Tamilnadu Prohibition Act r/w. Rule-7 of Tamilnadu Rectified Spirit Rule-2000 and hence, seeks anticipatory bail. 2.It is submitted by the learned counsel for the petitioner that the petitioner's name does not find place in FIR and the petitioner was shown as an absconding accused in the charge sheet and therefore, he was not aware of the proceedings pending before the Judicial Magistrate and he is ready to appear for all future hearings.

3.Heard the learned Government Advocate(Crl.side) appearing for the State.

4.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Tenkasi, and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the said court on all future hearings. petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

5. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
