ORDER : The Court Made the following order :- The petitioner, who is arrayed as A1 in S.T.C.No.31 of 2012 on the file of the Judicial Magistrate No.II, (C.C.I.W.

Special Court), Tirunelveli apprehends arrest at the hands of the respondent police for an alleged offence punishable under Section 6(3)(4) of TNSC (RDCS) Order 1982 r/w 7(1)a(ii) of EC Act 1955 and 279 of IPC, in S.T.C.No.31 of 2012, in pursuance of the Non Bailable Warrant issued on 15.10.2012 and hence, seeks anticipatory bail. 2.The learned counsel for the petitioner submitted that the petitioner did not receive any summon from the concerned Court and he was not aware of the proceedings and the other accused, who faced trial were acquitted by the Judicial Magistrate. He would further submit that the petitioner undertakes to appear before the trial Court for all the future hearing.

4.Heard the learned Government Advocate (Criminal Side) appearing for the respondent.

5.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.

6. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, (C.C.I.W.Special Court), Tirunelveli and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand https://hcservices.ecourts.gov.in/hcservices/

only) with two sureties each for a like sum to the satisfaction of the Court concerned and on further condition that the petitioner shall appear before the concerned Court in all future hearings without fail. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

7. The petitioner shall appear before the concerned court within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
