When the matter is taken up for hearing, the learned Additional Public Prosecutor on instruction from the respondent police submits that they have conducted petition enquiry and the same was closed as civil in nature. Further, he submits that a civil suit is pending between the parties.

2.Therefore, depending on the decree/order of the civil Court, preserving a liberty to the petitioner to approach the respondent police again as per the decree/order of the civil Court, this Criminal Original Petition is disposed of.
