ORDER

This writ petition has been filed seeking Mandamus to direct the third respondent to issue receipts for the payment by the petitioner towards Professional Tax and Building Tax for White Pig Farm run by him at Survey No.535/141 in Padikkal Village, Chitharal, Vilavancode Taluk, Kanyakumari District, within the time limit that may be stipulated by this Court in the light of the instructions of the second respondent vide his letter in Na.Ka.No.A11/2464/2019 dated 20.10.2021.

It is the case of the petitioner that he had established White Pig Farm at S.No.535/141 in Padikkal Village, Chitharal, after obtaining necessary approval/ license from the authorities concerned, in the year 2010. While granting the license, the licensing authority had stipulated two conditions that (i)the pig farm should be maintained without any bad odour and harm to the environment and (ii) the effluent comes out from the farm should be removed by way of erecting bio-gas plant. In compliance of the same, the petitioner 2/5

erected two bio-gas plants inside his pig farm and the same was periodically maintained without any default. It is the grievance of the petitioner that he has been paying the tax regularly to the third respondent panchayat as professional tax. However, due to some personal vengeance, the third respondent refused to issue the receipt on his payment. In this regard, the petitioner sent a representation to the Assistant Director of Panchayat, Nagercoil, who has forwarded the petitioner's representation to the second respondent asking him to instruct the third respondent to take necessary action for renewing the licence after scrutinizing the necessary documents. However, there is no further action by the second and third respondents.

Thereafter also, the petitioner sent a representation to the second respondent, who in turn made inspection on the petitioner's pig farm along with third respondent and after finding that there is no violation, vide letter in Na.Ka.NO.A11/2464/2019, dated 20.10.2021, instructed the third respondent to issue receipts for the payment made by the petitioner towards professional tax and building tax and send copy of the same to the second respondent. However, the third respondent did not comply the same. Hence, the petitioner is before this Court.

3. The learned Additional Government Pleader, on instructions, submits that if the petitioner is ready to make the payment and on receipt of such payment, license would be renewed by the second respondent. 3/5
