ORDER
The present petition has been filed by A4 in C.C.No.2521 of 2019 pending on the file of the learned Judicial Magistrate No.II, Trichy, seeking to quash the final report in C.C.No.2521 of 2019 pending on the file of the 1/4
learned Judicial Magistrate No.II, Trichy, in connection with Crime No.12 of 2021 on the file of the first respondent, wherein the petitioner has been charged for the offence under Sections 419, 420, 465, 468, 471, 509 r/w 120(b) of IPC. 2.As per the case of the prosecution, the petitioner, who is a land broker, along with other accused persons, is alleged to have impersonated the de facto complainant, created two sale deeds, and sold the same to third parties. It is further alleged that the petitioner had acted as an identifying witness in both the sale deeds.
3.The learned counsel appearing for the petitioner submitted that the petitioner is only a land broker and, except for introducing the purchasers to the landowner, he has no role whatsoever to play. 4.Heard both sides and perused the material records. 5.Considering the fact that the petitioner is also one of the identifying witnesses in the sale deeds and that the allegation relates to the impersonation of the real landowner, this Court is of the considered opinion that there is prima facie material against the petitioner to continue the prosecution. 2/4
6.Under such circumstances, this Court does not find any merit in this petition. It is noted that no document numbers have been mentioned in the charge sheet. The trial Court is directed to dispose of the case on its own merits, without being influenced by any of the observations made by this Court. 7.With the above said observations, this Criminal Original Petition stands dismissed. Consequently, the connected Criminal Miscellaneous Petition is closed.
