Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The learned counsel for the petitioner submitted that the second petitioner was arrested and remanded to judicial custody. It is further submitted that there is no specific overt act attributed against the first petitioner and even as per the case of the prosecution, the accused had come to the scene of occurrence in a Toyoto car bearing registration No.TN 72 T 2671, but that number was assigned to a two wheeler.

2. The learned counsel for the petitioner further submitted that the first petitioner is a practicing advocate and he had lodged a private complaint against four officials of the respondent in Crl.M.P.No.5664 of 2012 and it is further submitted that the father of the first petitioner had lodged a complaint against the officials of the respondent and the same is registered in Crime No.211 of 2014. He would also submit that the petitioner has been falsely implicated in this case.

3. The learned Government Advocate (crl. Side) submitted that this Court had earlier considered the overt act attributed against this petitioner and was not inclined to grant anticipatory bail to him.

4. I have gone through the record in Crl.O.P.(MD)No.3984 of 2015. This Court has considered elaborately and dismissed the application stating that the custodial interrogation of the accused is necessary in this case.

5. Accordingly, this petition is dismissed.
