PRAYER :- For Bail in Crime No.50 of 2020 on the file of the Respondent Police ORDER : The Court made the following order :- This petition has been filed by the petitioners/ accused No.1 & 2 seeking bail for the alleged offence punishable under Sections 379 of IPC r/w. 21(1) Mines and Minerals (Development and Regulation) Act, 1957

2. The case of the prosecution is that the petitioner was illicitly transporting one unit of river sand in his Boliro Max Truck bearing Reg.No. TN 50 AB 3515.

3. The petitioner was in incarceration from 03.03.2020. Being the first time offender he seeks bail since he is in jail for the past 14 days.

4. The learned Additional Public Prosecutor appearing for the State would submit that the petitioner was caught red handed while transporting river sand illegally.

5. Since illegal sand mining in Thanjavur District has become rampant, to curtail the illegal sand mining, the petitioner has to be detained under judicial custody or else there is every possibility for recurrence of the same offence. Hence, this Court is not inclined to grant bail to the petitioner.
