Prayer in CRL A(MD).No.257 of 2020:- Criminal Appeal is filed under section14-A (2) of the Seheduled Caste/Seheduled Tribes Act, 1989, as amended by Act 1 of 2016, to call for the records pertaining to the order dated 05/08/2020 made in Cr.M.P.No.315 of 2020 on the file of the learned Sessions Judge, (Additional Incharge) SC/ST (POA) Act, 1989, Special Court, Pudukkottai and to set aside the same and enlarge the appellants on bail in connection with Crime No.195 of 2020 on the file of the Second Respondent Police by allowing this Criminal Appeal. ORDER:- This Petition on coming on for hearing on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.R.M.S.Sethuraman, Advocate for the Petitioners and of Mrs.
Anandha Devi, Government Advocate for the respondents 1 and 2, this Court made the following order: This petition has been filed to relax the condition imposed by this Court in Crl.A.(MD)No.257 of 2020 dated 31.08.2020. 2.On the side of the petitioners, it is stated that the petitioners are complying the condition regularly. It is further stated that the second petitioner is a agricultural student and he has to attend exam from 22.09.2020 onwards and it is difficult for https://hcservices.ecourts.gov.
them to sign before the concerned police station daily and prayed the condition to be relaxed.
3.On the side of the prosecution, it is stated that the petitioners are complying the condition from 04.09.2020 onwards. 4.In view of the submissions made by both the counsel, this Court is inclined to modify the condition imposed by this Court in Crl.A.(MD)No.257 of 2020 dated 31.08.2020. Hence, this Criminal Miscellaneous Petition is allowed and the condition imposed on the petitioners is relaxed from 21.09.2020 onwards. The petitioners are directed to appear before the respondent police as and when required for interrogation.
