PRAYER :- To enlarge the petitioner on bail in connection with SC no.58/2018 in Crime No.927/2017 on the file of V Additional District and Sessions Judge, Madurai.
ORDER : The Court made the following order :- The petitioner/A1 herein was arrested and remanded to judicial custody on 23.04.2022 for the alleged offence under Sections 147,148,302,506(ii)of IPC in Crime No.927 of 2017 on the file of the respondent police seeks bail.
2. Originally the petitioner was granted bail in Crime No.927 of 2017. Subsequently hedid not appear before the trial Court in S.C. No.58 of 2018, as such Non Bailable Warramt was issuedon 19.01.2021. Thereafter the petitioner was arrested and remanded to judicial custody for the offences under sections 147,148,302,506(ii) of IPC. Thereafter he was detained under Act.14 of 1982 and subsequently the said detention order was quashed by this Court on 08.02.2023 in HCP(MD) No. 1761 of 2022, therefore the petitioner sought for bail.

CRL OP(MD). No.4184 of 2023 petition would submit that the petitioner is a habitual offender and he involved in 11 previous cases. Infact after issuance of Non Bailable Warrant on 19.01.2021, while pending Non Bailable Warrant he involved in two cases within the Chennai jurisdiction. In pursuant to the said crime he was arrested and remanded to judicial custody on 23.04.2022. Subsequently the respondent invoked Act.14 of 1982 and thereafter it was quashed. Further, if the petitioner is released on bail, he may abscond again.
5.Taking into consideration the fact that though the contention of the petitioner that the detention order was quashed by this Court only because of the absence of this petitioner the trial is not yet commenced, hence this Court is not inclined to grant bail to the petitioner.
