For Respondent : Mr.M.Chandrasekaran, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Anticipatory Bail in Crime No. 12 of 2013 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioners, who apprehends arrest at the hands of the respondent police in S.C.No.327 of 2018 on the file of the 2nd Additional District & Sessions Court, Thoothukudi for the offences punishable under Sections 307, 302 and 109 IPC, seek anticipatory bail.
2.The petitioners were absent during the trial in S.C.No.327 of 2018 on the file of the 2nd Additional District & Sessions Court, Thoothukudi. Therefore, Non-Bailable Warrant came to be issued. CRL OP(MD)No.4392 of 2021 appear before the concerned Judge, within a period of two weeks from the date of receipt of copy of that order. However, they failed to appear in time.
3.The learned counsel appearing for the petitioners would submit that the counsel was unable to contact the petitioners and failed to communicate the same. Hence, the present petition. He undertakes that the petitioners shall appear before the Court below regularly on all future hearing dates without fail. 4.Considering the undertaking given by the petitioners, the petitioners are directed to appear before the 2nd Additional District & Sessions Court, Thoothukudi, within a period of two weeks from the date of receipt of copy of this order and to file a petition to recall the NBW issued against them.
