Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as 12th accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 120(B), 420, 468, 471 and 506(i) of I.P.C in Crime No.14 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.
2.The case of the prosecution is that one Saratha, who is a member of a Trust namely Ashramam Kalvi Arakkattalai, Karur, lodged a complaint stating that the accused failed to furnish proper accounts and thereby committed cheating.
3. The learned counsel for the petitioner submitted that the defacto complainant is the former secretary of the trust and the case is registered on the basis of the direction given by the learned Judicial Magistrate under Section 156(3) Cr.P.C. It is further submitted that the petitioner is innocent and she has been falsely implicated in this case. 4.The learned Government Advocate (Crl.side) submitted that there is a dispute between the trustees of Ashramam Kalvi Arakkattalai, Karur and the allegation is that the accused has not furnished proper accounts.
5. Considering the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.
6. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.2, Karur and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like https://hcservices.ecourts.gov.in/hcservices/
sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 06.00 p.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
7.
