ORDER

The present writ petition has been filed seeking a mandamus directing the first respondent to issue fresh passport to the writ petitioner.

2. The learned Government Advocate(crl.side) appearing for the second respondent brought to the notice of the Court that the petitioner has been implicated in a criminal case in Cr.No.23 of 2023 on the file of the second respondent on the basis of the complaint lodged by the wife of the writ petitioner. So far, the charge sheet has not been laid.

3. Considering the fact that so far charge sheet has not been laid and the issue relates to a matrimonial dispute, there is no legal impediment for the first respondent to consider the request of the petitioner for issuance of the passport. The first respondent is directed to consider the application of the petitioner within a period of 4(four) weeks from date of receipt of a copy of this order.

4. With the above said observations, this writ petition stands disposed of. No costs.
