ORDER : The Court Made the following order :- Today this matter is taken up as "for being mentioned" at the instance of the learned counsel for the petitioner. The learned counsel for the petitioner submitted that though the petition has been filed for bail and this Court has granted the same, the order has been inadvertently typed as anticipatory bail order. Therefore, he prayed this Court to issue corrected order copy. 2.Heard the learned Government Advocate (criminal side) on the submission made by the learned counsel for the petitioner. 3.A perusal of the record would go to show that the petition has been filed for bail only and inadvertently the order has been typed as anticipatory bail order, instead of bail order. Therefore, the following order is passed:
"The petitioner, who is arrayed as A1 in Crime No.188 of 2015 on the file of the respondent police, was arrested and remanded to judicial custody on 10.05.2015 for the alleged offences punishable under Sections 6(2)(3)(4) of TNSC (RDCS) Order r/w 7(1)(a)(ii) of the Essential Commodities Act, 1955 and hence, seeks bail.
2.The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case. He further submitted that the accused 3 and 4 have already been granted anticipatory bail by this Court on 21.05.2015 in Crl.O.P(MD)No.9357 of 2015. https://hcservices.ecourts.gov.in/hcservices/
3.The learned Government Advocate (crl.side) submitted that there is no previous case pending against the petitioner. 4.Considering the facts and circumstances of the case and also considering the fact that the accused 3 and 4 have already been granted anticipatory bail, I am inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I,Virudhunagar and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m until further orders." sd/- 01/06/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
