ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody in respect of the offences punishable under Sections 395 and 397 of Indian Penal Code, in P.R.C.No.7 of 2011, on the file of the learned Judicial Magistrate, Muthukulathoor, seeks bail.
2. It is seen that this petitioner is the accused of the offences punishable under Sections 395 and 397 of Indian Penal Code. He was already arrested and released on bail. When the case is pending, he did not appear before the learned Judicial Magistrate, Muthukulathoor on 25.07.2014, on account of which, non-bailable warrant was issued. This petitioner was arrested only on 23.11.2014 after a lapse of about 3-4 months. The petitioner also did not choose to surrender before the learned Magistrate concerned. Since committal is not completed in this case, I am not inclined to grant bail to the petitioner at this stage. Hence, the petition seeking bail is dismissed. However, the learned Magistrate concerned is directed to expeditiously complete the committal process and send a report to this Court.
