ORDER

This Writ Petition has been filed challenging the Refusal Check Slip No. RFL/Melur-Thoothukudi/4/2026 dated 14.01.2026 issued by the second respondent and consequently seeking a direction to the second respondent to register the General Power of Attorney in respect of the properties situated in Survey No.504/2B1A at Meelavittaan Village, Melur, Thoothukudi Taluk, Thoothukudi District and in Survey No. 407/5A2 at Korampallam Village, Melur, Thoothukudi Taluk,

2. Mr.M.Lingadurai, learned Special Government Pleader, takes notice for the respondents.

3. The learned counsel appearing for the petitioner submitted that the General Power of Attorney dated 12.01.2026 was refused registration on the ground of non-production of patta. However, according to the petitioner, the patta had already been produced before the registering authority and without properly verifying the same, the impugned refusal check slip came to be issued.

4. The learned Special Government Pleader appearing for the respondents submitted that the refusal was made on account of nonproduction of patta. He further submitted that if the petitioner has already furnished the patta, the second respondent may be directed to verify the same and take appropriate action in accordance with law.

5. Considering the submissions made on either side, this Court is of the view that when the refusal is solely on the ground of nonproduction of patta and the petitioner claims to have already produced the same, the matter requires reconsideration by the registering authority.

6. Accordingly, the impugned Refusal Check Slip No. RFL/MelurThoothukudi/4/2026 dated 14.01.2026 is set aside. The petitioner is directed to re-present the General Power of Attorney along with the patta and all relevant documents before the second respondent within a period of two weeks from the date of receipt of a copy of this order. On such representation, the second respondent shall verify the patta and other documents and, if the document is otherwise in order and complies with the provisions of the Registration Act and the Rules framed thereunder, shall register the same, without insisting upon any further irrelevant requirements, within a period of four weeks thereafter. 3/5

7. With the above directions, this Writ Petition stands disposed of. No costs.

Consequently, the connected miscellaneous petition is closed.
