ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused in Crime No.18 of 2015 on the file of the respondent police, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 498 (A), 406, 294(b), 506(ii) of IPC and Section 4 of Dowry Prohibition Act and hence, seek anticipatory bail.
2. The case of the prosecution is that the petitioners harassed the defacto complainant and demanded dowry from her.
3. It is submitted by the learned counsel for the petitioners that the petitioners 1 and 2 are the in-laws and the third petitioner is the husband of the defacto complainant and the petitioners are innocents persons and they have not committed any offence as alleged by the prosecution and hence prays for anticipatory bail in favour of the petitioners.
4.The learned counsel for the intervenor has strongly objected for granting anticipatory bail to the petitioners. 5.Heard the submissions of the learned Government Advocate(Crl. Side) https://hcservices.ecourts.gov.in/hcservices/
*6.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the third petitioner, with certain conditions. Accordingly, the third petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.VI, Madurai and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the third petitioner shall appear before the respondent police daily at 5.00 p.m., until further orders. The third petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
7.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. *Time is extended till 14.12.2015 for execution of sureties, from today.
