Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as the sixth accused, apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 148, 294(b), 341, 302 IPC in Crime No. 100 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.

2.The case of the prosecution is that due to previous animosity, the accused have attacked the deceased with lethal weapons and caused the death.

3.The learned counsel for the petitioner submitted that the petitioner is arrayed as the sixth accused in this case and the accused 1 to 5 were already arrested and released on bail and there is no specific overt act attributed against this petitioner. 4.Per contra, the learned Government Advocate(Crl.side) appearing for the State submitted that as per FIR, the petitioner had attacked the deceased on the head and shoulder, which lead to the death.

5.Considering the overt act attributed against this petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this petition is dismissed. 6.However, it is open to the petitioner to surrender and seek regulary bail before the concerned court.
