ORDER : The Court Made the following order :- The petitioner is arrayed as the first accused, who was remanded to the judicial custody by the respondent police on 08.05.2015 for the alleged offence under Sections 294(b), 324 and 302 of I.P.C. based on the complaint in Crime No.183 of 2015 on the file of the respondent police, seeks bail.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the State and the learned counsel appearing for the intervenor and also perused the materials available on record.

3. The allegation against the petitioner is that the petitioner has attacked the deceased with wooden log. The alleged occurrent took place on 07.05.2015 and the petitioner was arrested on 08.05.2015 and custodial interrogation of the petitioner is over. The petitioner has been incarceration for more than 40 days and investigation is nearing completion.

4.The learned counsel for the intervenor submitted that the petitioner has suppressed the fact of filing application before the court below.

5.This Court is of the view that the said fact cannot be the ground to reject the bail application when liberty is given to him to work out his remedy in law.

6. Considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail on the following conditions. Accordingly, the petitioner is directed to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the https://hcservices.ecourts.gov.in/hcservices/
