ORDER

This Criminal Original Petition has been filed to direct the learned I Additional District Sessions Judge (Special Court for P.C.R) Trichy, to consider the bail application of the petitioner on the same day of his surrender before that court in connection with Crime No. 65 of 2026 on the file the respondents.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. Gist of the case: The third respondent has given a complaint as against the petitioners herein. The third respondent belongs to Schedule 2/5

Caste. On 05.02.2026, in intoxicated condition, the petitioners / accused persons along with the accused Nos.1 and 2, abused the defacto complainant in filthy language and critizing him with his caste and assaulted him by pushing him down and pulling his hair. The accused persons have also damaged the doors and asbestos sheet of the defacto complainant's house. Hence the complaint in Crime No.65 of 2026 has been registered for the offences under Sections 191, 296(b), 115(2), 351(2) of BNS, 2023 and 3(1)(r), 3(1)(r), 3(1)(s), 3(2)(va) of SC/ST (Prevention of Atrocities) Act, 1989.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby directs the learnedI Additional District Sessions Judge (Special Court for P.C.R) Trichy, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No. 65 of 2026 on the file of the 2nd respondent police. The petitioner shall 3/5

surrender before the learned Trial Court within a period of 15 days from the date of receipt of a copy of this order.
