PRAYER :-For Bail in Crime No.13 of 2022 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner /sole accused who was arrested and remanded to judicial custody on 18.05.2022 for the offences under sections 5(l), 5(j)(ii),6(l) of POCSO (Amendment)Act, 2019 and 506(i) of IPC in Crime No.13 of 2022 on the file of the respondent police seeks bail.
2. The case of the prosecution is that the petitioner herein committed penetrative sexual assault on the minor victim girl due to which she became pregnant, hence the case.
3. Heard. Perused the materials available on record including the First Information Report.
4. Taking into consideration of the fact that the investigation has been completed and final report has been filed before the learned Sessions Judge, Mahila Court, Pudukottai and the same has been taken cognizance in Spl.S.C. No. 56 of 2022 and if the https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.4225 of 2023 petitioner is released on bail at this stage the petitioner will abscond and there will not be any progress in the trial. Further taking into consideration the heinous offence committed by the petitioner this court is not inclined to grant bail to the petitioner.
5. Hence the petition stands dismissed.
