ORDER

This Criminal Original Petition has been filed to modify the condition to effect that the petitioner shall appear before the respondent police daily at 10.30 a.m. instead of staying and signing before the learned Judicial Magistrate No.I,Dharmapuri on all working days at 10.30 a.m. and 5.00 pm. until further orders and during the holidays the petitioner is directed to report before the Deputy Superintendent of Police, Dharmapurai daily at 10.30 a.m., and 5.00 pm., until further orders as per the order passed in 1/3

Crl.M.P.No.567/2023 dated 16.02.2023 by the learned Principal Sessins Judge, Theni.

2. The petitioner was granted anticipatory bail by the learned Principal Sessions Judge, Theni in Crl.M.P. No.567 of 2023 dated 16.02.2023 directing the petitioner to stay and sign before the learned Judicial Magistrate No.I,Dharmapuri on all working days at 10.30 a.m. and 5.00 pm. until further orders and during the holidays the petitioner is directed to report before the Deputy Superintendent of Police, Dharmapurai daily at 10.30 a.m., and 5.00 pm., until further orders. He would further submit that the petitioner sustained grievous injuries and taking treatment at Government Theni Medical College Hospital and hence is unable to comply with the conditions imposed by the learned Principal Sessions Judge, Theni, hence he seeks modification of the said condition.

3. Heard the learned Additional Public Prosecutor appearing for the respondent police.

4. Taking into consideration the facts and circumstances of the case and also the fact that the petitioner sustained injuries, the condition imposed on the petitioner to stay and sign before the learned Judicial Magistrate No.I, Dharmapuri on all working days at 10.30 a.m. and 5.00 pm. until further orders and during the holidays the petitioner is directed to report before the Deputy Superintendent of Police, Dharmapuri daily at 10.30 a.m., and 5.00 pm., until further orders is modified to the effect that the petitioner shall report before the respondent police daily at 10.30 a.m., and 5.30 pm., for a period of four weeks and thereafter as and when required for interrogation. All other conditions imposed in the said order shall remain unaltered.
