3137-2020.oo(2) dated 24.12.2022 and thereby make necessary changes in the Patta Passbook as it is prior to the order of the second respondent dated 09.10.2019 pertaining to the property of lands comprised in Survey No.460/6, 458/1, 460/8, 453/3A, 460/9, 458/4, 458/2, 460/7, 526/16 and 527/3 situated at Sengipatti Village, Budhalur Taluk, Thanjavur District upon the consideration made by the petitioner's representation dated18.02.2023.

ORDER

This writ petition is filed seeking a direction to the respondents 2 and 3 to implement the order of the first respondent dated 27.12.2022 including the name of one Tamil Selvi in the revenue records relating to the subject properties.

2.Heard the arguments of Mr.S.Sivathilakar, learned counsel

appearing for the petitioner and Mr.A.Baskaran, learned Additional Government Pleader appearing for the respondents. 3.The main grievance of the petitioner is that though the first respondent passed an order on 27.12.2022, the same has not been given effect to and the patta in the name of petitioner has not been restored in respect of the subject properties.

4.The above mentioned Tamil Selvi filed a writ petition in WP(MD)No.6598 of 2023, challenging the order passed by the first respondent dated 27.12.2022 and hence, the said order has not been given effect to till date. Therefore, the instant writ petition has not been considered till date. Now, the writ petition filed by Tamil Selvi in WP(MD)No.6598 of 2023 is dismissed today, by relegating the parties to workout their remedy before the Civil Court.

5.In such circumstances, there cannot be any impediment for the respondents 2 and 3 to implement the order passed by the first respondent. Accordingly, this Writ Petition stands allowed. The third

respondent is directed to give effect to the order passed by the first respondent dated 27.12.2022. It is made clear that the mutation in revenue records pursuant to the order passed by the first respondent is subject to the result of the civil litigation between the parties. No costs.
