PRAYER :- Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus forbearing the first respondent herein from registering any documents for Survey Nos 956/5, 955, 966/1, 967/1 situated in Vada Veeranaickenpatti Village, Periyakulam Taluk, Theni District pertaining to A-Schedule of properties in Registered Partition Deed dated 24.03.2022 vide Doc No.3016/2022 on the file of Sub Registrar, Theni, to any fraudulent persons without conducting proper enquiry.

This writ petition has been filed seeking a direction to the first respondent herein from registering any documents for Survey Nos 956/5, 955, 966/1, 967/1 situated in Vada Veeranaickenpatti Village, Periyakulam Taluk, Theni District pertaining to A-Schedule of properties in Registered Partition Deed dated 24.03.2022 vide Doc No.3016/2022 on the file of Sub Registrar, Theni, to any fraudulent persons without conducting proper enquiry.
2. Heard the learned counsel for the petitioner, the learned Additional Government Pleader appearing for the respondents. By consent of both sides, the writ petition itself is taken up for final disposal 2/5
at the stage of admission itself. Since no adverse orders are going to be passed against the private respondents, notice is dispensed with.
3. The petitioner submitted a representation on 08.08.2025 to the first respondent not to register any document for the property in question. However, since no action has been taken on the said representation, the petitioner is before this Court with this writ petition.
4. Learned Additional Government Pleader for the respondents, would submit that within a considerable period, the representation would be considered. He would further submit that in the event if any document is presented for the property in question, the petitioner's objection will be considered.
5. In view of the above submissions, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the 1st respondent to consider the petitioner's representation 08.08.2025 with regard to the objections raised therein and if any document is presented for registration for the property in question, the 1st respondent is directed issue notice and hearing the parties concerned and 3/5
thereafter take a decision in accordance with law. There shall be no order as to costs.
