O R D E R

The Criminal Original Petition is filed for a direction to the respondents to conduct the investigation and to file the final report in Crime No.84 of 2016, on the file of the second respondent police before the concerned Court within the stipulated time frame as fixed by this Court.

2.Heard Mr.B.Jameel Arasu, learned Counsel appearing for the petitioner and Mr.K.S.Durai Pandian, learned Additional Public Prosecutor, who takes notice for the respondents. 3.The petitioner is the de-facto complainant in Crime No.84 of 2016. The petitioner gave a complaint before the second respondent and the same was registered in Crime No.84 of 2016, for the offences punishable under Sections 147, 420 and 506(i) IPC. It is further stated that after the registration of the case, there was no further investigation and a direction from this Court to the respondents to file a final report will be in the interest of justice.

4.The learned Additional Public Prosecutor, on instructions stated that the complaint itself was closed as mistake of fact on 31.12.2016 and the RC notice was also served on the petitioner. https://hcservices.ecourts.gov.in/hcservices/

5.However, the learned Counsel for the petitioner disputed the service of the RC notice. The learned Additional Public Prosecutor also served a copy of the closure report as well as the RC Notice today on the learned Counsel for the petitioner. Hence, the Criminal Original Petition is closed.
